Agreement to Terms
These Terms of Service ("Terms") govern your use of curbandgourd.com (the "Site") and any order you place with Curb & Gourd. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
Our Service
Curb & Gourd provides seasonal pumpkin display collections, delivery, and — depending on the collection selected — professional on-site design and setup, within our service area of King and Snohomish Counties, Washington. Collection contents, included services, and pricing are described on each collection's product page and are current as of the date you view them; pricing and availability are subject to change without notice.
Orders & Payment
Placing an order through the Site (via "Place Order" at checkout) completes a purchase of your selected collection, add-ons, and delivery fee, and payment is collected at checkout. Submitting an order sends your delivery details and preferred delivery week to us; a member of our team may follow up to confirm final details ahead of your scheduled delivery.
Pricing & Delivery Fees
Collection and add-on prices are shown on the Site. A separate delivery fee applies based on your ZIP code and delivery zone, shown at checkout and on our Delivery page; this fee is charged in addition to the collection price, even for collections described as including delivery as a service. Final pricing, including any applicable delivery fee, is calculated from your ZIP code and confirmed at checkout before payment is collected.
Product Variability
Pumpkins are natural, seasonal products. Exact colors, shapes, sizes, and varieties may vary. When a particular variety is unavailable, Curb & Gourd may substitute a comparable variety of similar size, color, quality, or design function while maintaining the overall composition and value of the selected collection.
Scheduling, Weather & Rescheduling
We deliver and install Monday through Saturday within our service area. We install in nearly all weather conditions. In the rare case of conditions that make delivery or installation unsafe, we will proactively contact you to reschedule your delivery window at no additional cost.
Season-End Removal
Seasonal Display Removal is available as an add-on at checkout for a flat rate. If selected, we will contact you after your purchase to schedule a removal date. Removal is not automatic and applies only to orders where it has been added.
Cancellations
Because orders are confirmed directly with our team before payment is finalized, cancellation requests made before that confirmation can be made at no cost by contacting us at concierge@curbandgourd.com or (425) 395-4669. Cancellation terms for confirmed, paid orders will be provided at the time payment is arranged.
Site Content & Intellectual Property
The text, graphics, photos, and design of the Site are owned by Curb & Gourd or used with permission, and may not be copied or reused without our written consent.
Limitation of Liability
To the extent permitted by law, Curb & Gourd is not liable for indirect, incidental, or consequential damages arising from use of the Site or from delivery and installation services, beyond the amount paid for the applicable order. Nothing in these Terms limits liability that cannot be limited under applicable Washington or federal law.
Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
