Agreement to Terms

These Terms of Service ("Terms") govern your use of curbandgourd.com (the "Site") and any order you place with Curb & Gourd. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

Our Service

Curb & Gourd provides seasonal pumpkin display collections, delivery, and — depending on the collection selected — professional on-site design and setup, within our current delivery zones in King and Snohomish Counties, Washington, as shown on our Delivery page. Collection contents, included services, and pricing are described on each collection's product page and are current as of the date you view them; pricing, availability, and delivery zones are subject to change without notice.

Orders & Payment

Placing an order through the Site (via "Place Order" at checkout) completes a purchase of your selected collection, add-ons, and delivery fee, and payment is collected at checkout. Submitting an order sends your delivery details and preferred delivery week to us; a member of our team may follow up to confirm final details ahead of your scheduled delivery.

Pricing & Delivery Fees

Collection and add-on prices are shown on the Site. A separate delivery fee applies based on your ZIP code and delivery zone, shown at checkout and on our Delivery page; this fee is charged in addition to the collection price, even for collections described as including delivery as a service. Final pricing, including any applicable delivery fee, is calculated from your ZIP code and confirmed at checkout before payment is collected.

Product Variability

Pumpkins are natural, seasonal products. Exact colors, shapes, sizes, and varieties may vary. When a particular variety is unavailable, Curb & Gourd may substitute a comparable variety of similar size, color, quality, or design function while maintaining the overall composition and value of the selected collection.

Scheduling, Weather & Circumstances Beyond Our Control

We deliver and install Monday through Saturday within our service area. We install in nearly all weather conditions. In the rare case of weather, road conditions, or other circumstances beyond our reasonable control — including severe weather, natural disaster, supply shortages, or similar events — that make delivery or installation unsafe or impracticable, we will proactively contact you to reschedule your delivery week at no additional cost. Curb & Gourd is not liable for delays caused by such circumstances.

Season-End Removal

Seasonal Display Removal is available as an add-on at checkout for a flat rate. If selected, we will contact you after your purchase to schedule a removal date. Removal is not automatic and applies only to orders where it has been added.

All Sales Are Final

All purchases made through the Site are final. Because each collection is sourced, prepared, and scheduled specifically for your delivery week using perishable, seasonal inventory, Curb & Gourd does not offer cancellations, refunds, exchanges, or credits once an order has been placed, for any reason, including a change of mind, a scheduling conflict, or dissatisfaction with the natural variation described under Product Variability above. Please review your collection, add-ons, delivery address, and delivery week carefully before completing checkout, as orders cannot be modified once placed.

This policy does not limit any right you may have under applicable law, and it does not apply to our own errors in fulfilling your order. If your order was affected by a mistake on our part — the wrong collection delivered, a missed delivery week, or a similar service failure — contact us at concierge@curbandgourd.com or (425) 395-4669 and we will work with you in good faith to make it right.

Site Access, Delivery & Installation on Your Property

By scheduling a delivery that includes on-site design and setup, you grant Curb & Gourd and its crew permission to access the relevant area of your property (such as your porch, steps, or entryway) during your scheduled delivery week for the purpose of installing your collection. You are responsible for ensuring that the installation area is reasonably clear, accessible, and structurally able to support the collection you selected. Curb & Gourd is not responsible for damage arising from pre-existing conditions of the property, including but not limited to unstable or deteriorated steps, railings, planters, or surfaces.

Our crew takes reasonable care while on your property. If you believe our crew caused damage during delivery or installation, notify us within 48 hours of your delivery at concierge@curbandgourd.com or (425) 395-4669 so we can promptly look into it; claims reported after that window may be difficult for us to verify. Pumpkins, gourds, and hay bales are natural, outdoor products that may attract wildlife or insects over time and are not intended for consumption; Curb & Gourd is not responsible for such natural occurrences once a display is installed.

Site Content & Intellectual Property

The text, graphics, photos, and design of the Site are owned by Curb & Gourd or used with permission, and may not be copied or reused without our written consent.

Limitation of Liability

To the extent permitted by law, Curb & Gourd is not liable for indirect, incidental, or consequential damages arising from use of the Site or from delivery and installation services, beyond the amount paid for the applicable order. Nothing in these Terms limits liability that cannot be limited under applicable Washington or federal law.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any dispute arising from these Terms or your order will be resolved in the state or federal courts located in Snohomish County, Washington, and you consent to the personal jurisdiction of those courts. Before filing a claim, we encourage you to contact us directly at concierge@curbandgourd.com so we can try to resolve the issue informally.

Severability

If any provision of these Terms is found unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with the order details confirmed with you, constitute the entire agreement between you and Curb & Gourd regarding your order and supersede any prior agreements or understandings, whether written or oral. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
